Nature of Our Service and Content

Please note that Evaulthub does not host or store any copyrighted video or media files on its own servers. Our service functions primarily as an index or search engine, discovering and providing links to content that is already publicly available on the internet through various third-party websites and streaming sources (hosted at may.evaulthub.com and related services). We do not upload, control, or modify the content located at these external sources. All content linked to is the property of its respective owners and is assumed to be publicly accessible where found.

While we do not host the content itself, we respect intellectual property rights and will promptly process valid DMCA notices by removing the specific link(s) from our index that point to allegedly infringing material. Removing a link from our service does not remove the content from the third-party site where it originates. Copyright holders seeking removal of the actual content must contact the administrator or hosting provider of the site where the content is physically stored.

DMCA Notice & Takedown Procedure

In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our service that are reported to our Designated Copyright Agent identified below.

DMCA Notice of Alleged Infringement ("Takedown Notice")

To be effective, the Takedown Notice must be a written communication provided to our Designated Copyright Agent that includes substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material (e.g., the specific link(s) on our site) that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Providing the exact URL(s) on may.evaulthub.com is the most effective way.
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material (referenced by the link) in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Failure to include all of the above information may result in a delay in processing the DMCA notification. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Upon receipt of a valid Takedown Notice as described above, we will expeditiously remove or disable access to the link(s) pointing to the allegedly infringing material identified in the notice. We will also attempt to notify the user who may have submitted the link, if applicable and identifiable.

Counter-Notice Procedure

If you believe that a link referencing your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice") by submitting written notification to our Designated Copyright Agent (identified above). Pursuant to the DMCA, the Counter-Notice must include substantially the following:

  1. Your physical or electronic signature.
  2. An identification of the link(s) that have been removed or disabled and the location at which the link(s) appeared before removal or disabling.
  3. A statement under penalty of perjury by you that you have a good faith belief that the link(s) were removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, for any judicial district in which Evaulthub may be found), and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.

Upon receipt of a valid Counter-Notice, we may send a copy to the original complaining party informing them that we may replace the removed link(s) or cease disabling access in 10 business days. Unless the copyright owner files an action seeking a court order against the user, the removed link(s) may be replaced, or access restored, in 10 to 14 business days or more after receipt of the Counter-Notice, at our sole discretion.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Evaulthub may adopt a policy of terminating, in appropriate circumstances and at our sole discretion, users or accounts (if applicable to the service) who are deemed to be repeat infringers. We may also at our sole discretion limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Modifications to Policy

We reserve the right to modify the terms of this DMCA policy at any time. Any changes will be effective immediately upon posting the revised policy on this page.
